Privacy Notice

This Notice is provided by Taiwan Semiconductor Manufacturing Company Limited and its affiliates (together “TSMC”). The purpose of this Notice is to provide information to individuals (“you”) who register on our TSMC website, apply for roles with TSMC, apply for semiconductor academic programs sponsored or co-sponsored by TSMC (“Semiconductor Program”) or register for events or similar activities hosted by TSMC.

Any personal data you provide in this context shall be processed in accordance with applicable data protection laws and regulations, as detailed in TSMC’s Privacy Policy, which is available in GermanEnglish and Chinese (the “Privacy Policy”). 

TSMC may collect, process (including without limitation, transmit by fax, mail or Internet) and use (collectively, “Process”) your personal data for the following purposes:

  • for recruitment, employment or personnel management;
  • for management and organization of the specific Semiconductor Program, event or similar activity for which you applied or registered;
  • to communicate with you regarding the specific Semiconductor Program, event or similar activity for which you applied or registered;
  • to send you information relating to the Semiconductor Program, event or similar activity or to ask for your feedback as part of our commitment to continuous improvement;
  • to send you information about our activities to promote and maintain our relationship with you, including information on job openings, career events, education programs as well as engagement messages related to joining TSMC (e.g., an invitation to update the candidate profile); and
  • for compliance with law, and establishment, exercise or defense of legal claims, as further detailed in this Notice, and in the Privacy Policy.

TSMC may additionally process your personal data, including your assessment and interview results, if any, for the purposes of potential consideration in future job opportunities within TSMC. This may include job suitability assessments, sending you relevant job offers tailored to your profiles, invitations to update your profile, and providing further information. TSMC will additionally seek your consent to process this personal data for these purposes, to the extent required by applicable law.

TSMC may retain your personal information for as long as reasonably necessary until such purposes no longer exist and thereafter for as long as necessary to comply with applicable law as further detailed in the Privacy Policy. Additional notices, in specific jurisdictions, are set out below.
Additional Notice in relation to the EU and the UK
If you apply for a position at TSMC Europe B.V., the controller in respect of the Processing of your personal data is TSMC Europe B.V., WTC Amsterdam Tower H7, Zuidplein 60, 1077 XV Amsterdam, The Netherlands (hereinafter “TSMC Europe B.V.” or “we”/“us”).

Data We Process, Purposes and Legal Bases

When registering on the TSMC website, we process your personal data when you create an account. This may include your name, email address, and contact details. We process your personal data to identify you as a user of our services and customize your experience. The legal basis for this is Art. 6 (1) lit. f) GDPR and our legitimate interest in providing you with the opportunity to create and maintain an account with us.

When registering to an event or similar activity, we process your personal data that we receive through your registration. This may include contact data, personal data such as name, gender, military service details and education information related to your registration to the event or similar activity. We process your personal data to identify you as an attendee to a TSMC event or similar activity and to customize your experience. The legal basis for this is Art. 6 (1) lit. f) GDPR and our legitimate interest in offering you the opportunity to participate in events or similar activities. If we enter into an agreement with you in this context, the legal basis for this will be processing which is necessary for the performance of a contract (Art. 6 (1) lit. b) GDPR). In the event that we use direct marketing measures in this context, we will obtain your consent and the legal basis for processing will be Art. 6 (1) lit. a GDPR.

When applying to a Semiconductor Program, we process your personal data that we receive through your application documents and interviews with you. This may include contact data and all data related to the application (CV, certificates, qualifications, etc.). We process your personal data to identify you as an attendee to a Semiconductor Program and to customize your experience. The legal basis for this is Art. 6 (1) lit. f) GDPR and our legitimate interest in offering you the opportunity to participate in a Semiconductor Program. If we enter into an agreement with you in this context, the legal basis for this will be processing which is necessary for the performance of a contract (Art. 6 (1) lit. b) GDPR). In the event that we use direct marketing measures in this context, we will obtain your consent and the legal basis for processing will be Art. 6 (1) lit. a GDPR.

When sending you information about our activities to promote and maintain our relationship with you, including information on job openings, career events, education programs as well as engagement messages related to joining TSMC (e.g., an invitation to update the candidate profile), we process your personal data that we receive when you create an account. This may include your name, email address, and contact details. In the event that we use direct marketing measures in this context, we will obtain your consent and the legal basis for processing will be Art. 6 (1) lit. a GDPR.

When applying for a position at TSMC, we process your personal data that we receive through your application documents and interviews with you. This may include contact data and all data related to the application (CV, certificates, qualifications, etc.).

We process your data to carry out the application process and to check whether we can offer you the position for which you have applied and hire you. The legal basis for this is Art. 6 (1) lit. b) GDPR. Insofar as your consent has been obtained for processing of personal data, for example to store your personal data in order to be considered for future job opportunities at TSMC, Art. 6 (1) lit. a) GDPR is the legal basis for the data processing. If you apply to ESMC GmbH, Art. 6 (1) lit. a) GDPR applies in conjunction with Section 26 (2) of the German Federal Data Protection Act (Bundesdatenschutzgesetz, “BDSG”). Any consent given can be withdrawn at any time with effect for the future. Insofar as the data are special categories of personal data (such as data about your health) that you provide to us yourself (for example, information about a severely disabled status), the processing is carried out on the legal basis of Art. 9 (2) lit. b) GDPR. If you apply to ESMC GmbH, Art. 9 (2) lit. b) GDPR applies in conjunction with Sec. 26 (3) BDSG. 

Data Erasure

Your personal data will be deleted as soon as storage is no longer necessary, subject to applicable statutory retention periods. For candidates applying for a position at TSMC in Germany, if you are not hired, this is usually no later than six months after completion of the application process. In the Netherlands, it is usually within four weeks. If you are not hired, but your application is still of interest to us, we will ask you for your consent whether we may continue to store your application for future job openings and will retain your personal data until you withdraw your consent.

If you create an account with us on the TSMC website, we will retain your personal data processed in this context, as long as the account remains active (i.e., until you have instructed us to delete the account) and thereafter as is permitted under applicable data protection laws and regulations or required in accordance with statutory retention obligations.

If you register for events or similar activities, or apply for Semiconductor Programs, we will retain your personal data processed in this context for as long as it is necessary to perform the events or similar activities or the Semiconductor Program and thereafter as is permitted under applicable data protection laws and regulations or required in accordance with statutory retention obligations.
If we have obtained your consent in relation to direct marketing measures, we will retain your personal data processed in this context as long as the consent given is valid (e.g., has not been withdrawn by you).

Recipients of Your Data

We may transfer your personal data, including special categories of personal data, to Taiwan Semiconductor Manufacturing Company Limited and its affiliates and associates, including TSMC North America, TSMC Europe B.V., TSMC Japan Limited, TSMC Design Technology Japan, Inc. TSMC Japan 3DIC R&D Center, Inc., TSMC Korea Limited, TSMC Partners, Ltd., TSMC Global Ltd., TSMC China Company Limited, TSMC Nanjing Company Limited, VisEra Technologies Company Ltd., TSMC Arizona Corporation, Japan Advanced Semiconductor Manufacturing, Inc., European Semiconductor Manufacturing Company (ESMC), Systems on Silicon Manufacturing Company Pte. Ltd., Vanguard International Semiconductor Corporation, Global Unichip Corporation, Xintec Technology Co., Ltd., TSMC Development, Inc., TSMC Washington, LLC, TSMC Technology, Inc., and TSMC Design Technology Canada Inc., if we have obtained your consent to store the personal data you provided for your application in the TSMC Talent Network for possible use for future job offers within the TSMC Group. Your personal data, including special categories of personal data, may also be transferred to Taiwan Semiconductor Manufacturing Company Limited for operating the candidate database, operating the TSMC website and routine backup of electronic information.

We also use service providers for our application process via whose platforms you can apply to us (such as for example LinkedIn, Stepstone or XING) or whose cloud-based software solutions we are using on our TSMC career website. We furthermore use service providers such as recruiting outsourcing companies and headhunting companies.

If you contact us via a recruiting platform or apply for an advertised position via this platform, the platform will either redirect you to the TSMC careers website or collect your personal data and make it available to us. This also involves storage and further processing by us, as described in the foregoing sections of this notice.

Please note that for any further processing on such recruiting platform the privacy policy of the respective platform is applicable.

Cross-Border Data Transfer

When using service providers for our application process or through involvement of Taiwan Semiconductor Manufacturing Company Limited and certain of its affiliates, transfers to third countries (countries outside the European Economic Area - EEA) such as Taiwan take place. These transfers are backed up by appropriate safeguards (such as EU Standard Contractual Clauses). We will provide you with these upon request via one of the contact options mentioned above.

Your Data Protection Rights

Your rights, including your right to complain to the relevant data protection authorities, are explained further in the Privacy Policy.
